1. Acceptance of Terms

By downloading, installing, or accessing ViralSpark — whether through the iOS app or the web app at viralsparkai.app — you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, please do not use the Service. These terms apply to all users of ViralSpark, including free and paid subscribers across all platforms.

2. Use of the Service

ViralSpark is an AI-powered content generation tool designed to help creators produce social media content faster. You may use generated content for personal and commercial social media purposes. You are solely responsible for reviewing and ensuring that all content is appropriate, accurate, and compliant with applicable laws and platform guidelines before publishing.

3. Subscriptions & Payments

ViralSpark offers a free Basic tier with limited generations and a Pro subscription with unlimited access. Pro subscriptions are billed at $9.99/month or $64.99/year (approximately $5.42/month). Payment processing depends on the platform you use:

iOS App (Apple App Store)

  • Payments are charged to your Apple ID at confirmation of purchase.
  • Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date.
  • You can manage or cancel your subscription in your Apple ID account settings.
  • Prices may vary by region based on App Store pricing.

Web App (Stripe)

  • Payments are processed securely by Stripe, Inc. using your credit or debit card.
  • Your email address is required to create and manage a web subscription.
  • Subscriptions auto-renew at the end of each billing period unless cancelled.
  • You can manage, upgrade, or cancel your subscription at any time via the Account panel in the web app or by contacting support.
  • All prices are in USD. Stripe may display local currency equivalents.

4. Refund Policy

iOS App purchases: All in-app purchases are processed by Apple. Refund requests must be submitted directly through Apple's refund process at reportaproblem.apple.com. OberonLabs does not control Apple's refund decisions.

Web App (Stripe) purchases: Subscriptions may be cancelled at any time. Upon cancellation, your Pro access remains active until the end of the current billing period — we do not offer partial-period refunds. If you believe you were charged in error, contact us within 7 days of the charge at hello.viralspark@gmail.com and we will review your case.

5. AI-Generated Content

Content generated by ViralSpark is produced by AI and may not always be accurate, appropriate, or effective. We do not guarantee specific outcomes including but not limited to follower growth, views, engagement rates, or revenue. You are responsible for all content you publish. 6. Prohibited Use

You may not use ViralSpark to generate content that is:

  • Illegal, hateful, defamatory, or discriminatory
  • Violating any platform's community guidelines (Facebook, YouTube, TikTok, Instagram)
  • Fraudulent, misleading, or designed to deceive
  • Sexually explicit or harmful to minors
  • Used for spam or automated mass publishing

We reserve the right to terminate access for misuse without refund.

7. Intellectual Property

ViralSpark and its original design, features, and functionality are owned by OberonLabs. You retain ownership of topics and inputs you provide. AI-generated outputs are not copyrighted by OberonLabs — you may use them freely for your content creation. However, we make no warranty of originality or uniqueness for AI-generated content.

8. Limitation of Liability

To the maximum extent permitted by law, OberonLabs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of ViralSpark, whether through the iOS app or web app.

9. Third-Party Services

ViralSpark integrates with the following third-party services. Your use of the Service is also subject to their respective terms and privacy policies:

  • Apple App Store — iOS payment processing and subscription management
  • Stripe, Inc. — Web payment processing and subscription management (stripe.com/privacy)
  • Third-Party AI Models — We utilize trusted external AI providers to enhance content quality. All inputs are processed transiently and are not retained.

10. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be published on this page with an updated date. Continued use of the Service after changes constitutes your acceptance of the updated terms. We recommend reviewing this page periodically.
